Stafford resident Daniel Schmitt is back on the wrong side of the law after getting his third DUI in 10 years when he sped through an intersection, struck a volunteer and then smashed into an embankment on Thursday morning.
The crash was reported shortly after midnight on Thursday, Sept. 21 when the Safety Volunteer was directing traffic in the area of Garrisonville Road and Keystone Drive while construction workers were conducting some paving project.
At the time he was struck, the volunteer had his marked Stafford County Sheriff's vehicle's emergency lights on, and he was wearing a reflective vest, which did not deter Schmitt.
He suffered minor injuries, but escaped any broken bones or major injury.
The 52-year-old driver continued on after hitting the man though he quickly crashed into a nearby embankment on Garrisonville Road near Algrace Boulevard.
Schmitt admitted to speeding, but a spokesperson for the sheriff's office said that he was "completely unaware he struck someone."
He later copped to enjoying seven drinks in Washington, DC before getting behind the wheel. Officials also made note his license was revoked due to a prior DUI incident, and he had two within the past 10 years.
Schmitt was arrested and charged with:
Driving under the influence (third offense in 10 years with a BAC over .20 percent);
- Felony hit-and-run;
- Driving after forfeiture of a license;
- Driving revoked in a manner to endanger life or limb;
- Failure to yield to flashing lights.
He's being held without bond.
